This RENTCafé Portal Site is operated by the Los Angeles County Development Authority (the “LACDA”) to offer housing services to program applicants, tenants/participants, and owners/landlords.  This Site uses the RENTCafé technology platform, which is owned by Yardi Systems, Inc. (collectively, with its subsidiaries and affiliates, “Yardi”).  To access Yardi’s Privacy Policy of the RENTCafé, please visit: https://www.rentcafe.com/apartments/privacypolicy.aspx. Please note that the Site is a 'Yardi Client-controlled' Site, operated by LACDA, as a client of Yardi, whereby LACDA retains 'data controller' rights."

The LACDA is providing this Privacy Notice which describes the LACDA’s privacy practices regarding the Personal and Non-Personal information we collect from you or members of your household who access the RENTCafé Portal website or our related mobile applications that may be available for download (collectively, the “Site”).

PURPOSE. The purpose of this Privacy Notice is to inform you about the types of information we collect about you, including information collected  when you visit the Site and information we may receive from third-parties or affiliates in addition to that online information, how we may use that information, whether we disclose that information, and the choices you have regarding our use of, and your ability to access and/or correct, the information.

This Privacy Notice does not cover information that is exempted from privacy policy notification requirements and any information gathered that is not specifically exempt from disclosure may be disclosed.  Please be aware that much of the information submitted to the LACDA is public information under the laws of the State of California.  Under some circumstances, the LACDA may be required to disclose such information in accordance with the California Public Records Act or other legal requirements.

 

POLICY NOTICE CHANGES

The LACDA may amend this Privacy Notice from time to time. Updates to this Privacy Notice will be made and published with a new “LAST UPDATE” date, as referenced above. Please regularly check the LACDA’s Privacy Notice for updates.

THE LACDA’S COLLECTION AND USE OF PERSONAL INFORMATION

The LACDA collects, processes, and stores various types of Personal Information. For purposes of this Notice, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. It does not include de-identified or aggregate information, or public information lawfully available from governmental records.

Personal Information we collect may include, but is not limited to: your full name, email addresses, postal addresses, postal codes, , Internet Protocol (“IP”) addresses, social security/insurance numbers, driver’s license numbers, prior addresses, income sources, income values, public assistance information, citizenship status, race, ethnicity, community service and self sufficiency requirement information, family self sufficiency and escrow information, tax filing status, dependent information, monthly rent paid at prior residences, employers, job titles, incomes, telephone numbers, credit card information, bank account information and routing numbers, date of birth, gender (M/F), age, marital status, user name and password (if you choose to become a registered user of the Site or our  services), emergency contact information, information about your pets, information about your vehicles, including license plate numbers, biometric information or biometric identifiers (if you choose to schedule a self-guided tour and/or use our identity verification services), and all other U.S. Department of Housing and Urban Development (“HUD”) or federal, state, or locally required information deemed necessary to comply with the LACDA’s housing programs.

You may not be able to access certain user-specific features of the Site or obtain certain services without providing Personal Information.

Your Personal Information will be used for all of the LACDA’s lawful purposes, including, without limitation, for the provision of housing services and/or information to program applicants, tenants/participants, and owners/landlords, and/or for all lawful disclosures pursuant to the LACDA’s powers and duties imposed by statute, regulation, executive order, court order, subpoena, ordinance, applicable governmental policies and procedures, or otherwise.  Such powers and duties include disclosure, including, without limitation, disclosure to third-parties, for all lawful purposes, including, without limitation, investigations, audits, studies, statistical analysis, research, reports, recordings, and/or other similar proceedings and all purposes compatible with such uses.

The LACDA may also collect and share Personal Information with third-parties when it believes, in good faith, that an applicable law requires it; at the request of governmental authorities; to detect and protect against fraud, or any technical or security vulnerabilities; to respond to an emergency; or to protect the rights, property, safety, or security of the LACDA, its service providers, its clients, third-parties, visitors to the Site, or the public.

Your Personal Information may be retained for as long as you use the Site or the LACDA’s  services. Retention periods may be extended if the LACDA is required to preserve your Personal Information pursuant to statute, regulation, executive order, court order, subpoena, ordinance, litigation holds, investigations, audits, studies, statistical analysis, research, reports, recordings, and/or other similar proceedings, and/or any applicable governmental policies or procedures,  or if a longer retention period is required or permitted by applicable law.

The LACDA and its third-party service providers do not and will not sell your Personal Information.

USE OF COOKIES AND OTHER TECHNOLOGIES.

Like many other website operators, the LACDA and its third-party service providers may use cookies to customize content specific to your interests and to track your use of the Site. “Cookies” are text files that are placed on your computer and may be used to store your Personal Information or other information. In addition to cookies, the LACDA and its service providers may use other now known or later developed technologies, to assist the LACDA in observing the behavior of users visiting the Site. These technologies access individual user information, but the information is used only to compile aggregated statistics about the Site’s usage.

This Site uses Google Analytics (and in the future may use other similar sites or services), a web analytics service provided by Google, Inc. (“Google”), to better assist the LACDA in understanding how the Site is used. Google Analytics will place cookies on your computer that will generate information that we select about your use of the Site, including your computer’s IP address. That information will be transmitted to and stored by Google. The information will be used for the purpose of evaluating use of the Site, compiling reports on Site activity for the LACDA’s use, and providing other services relating to Site activity and usage. Google may also transfer this information to third-parties where required to do so by law, or where such third-parties process the information on Google’s behalf. You can choose to delete existing cookies, allow or block cookies, and set preferences for certain websites in your browser’s settings. Please note that you may not be able to use the full functionality of the Site if you choose to block cookies.

COMMUNICATION, EMAIL, AND TEXT MANAGEMENTThe LACDA may also request information concerning your communication preferences.  You may receive emails and texts from the LACDA for a variety of reasons. The LACDA respects your desire to manage email and text correspondence. If you have an account with the LACDA on the Site, you can select your preferences through your account settings. You can also manage your receipt of certain types of communication by following the instructions included in the email and/or text that the LACDA sends you. Please note that, even if you unsubscribe from certain email and/or text correspondences, the LACDA may still need to email or text you with information relating to your unit, the management of the property, and other important transactional or administrative information.

Messages sent from mobile devices may contain unique identifiers about the physical location of such devices and may transmit caller identification data.  This information may include, without limitation, geolocation data, unique device identifiers and other information about your type of device, and wireless/cellular service provider data.  The LACDA may use such information to contact you and respond to your communications.

Email and text messaging are not secure forms of communication and are subject to interception.  Accordingly, do not disclose any information through such methods to the LACDA that you wish to remain private and/or confidential.  Please note that any information collected from an email or text message, including, without limitation, sender information, such as an IP address, and/or routing information, is not subject to the terms this Privacy Notice.

THIRD-PARTY WEBSITES. This Privacy Notice applies solely to the Site and to information collected by the LACDA. This Privacy Notice does not apply to other websites that are accessible through the Site, including, but not limited to, any LACDA service provider or third-party websites.  Such service provider and third-party websites are not within the LACDA’s control and may not follow the same privacy practices set forth in this Privacy Notice.

Any inclusion of LACDA service provider or third-party hyperlinks, images, applications, or references on the Site does not constitute an endorsement or recommendation by the LACDA of any service provider or third-party, or any product or service of a service provider or third-party.

ACCESSING, REVIEWING AND CHANGING YOUR INFORMATION. With some exceptions, as an account holder, you have a right to access records held by the LACDA that contain your Personal Information and to see what Personal Information on you the LACDA maintains record of.  You may also access, review, and change most of your contact information associated with your Account Profile by logging into your account and editing your Account Profile.

The LACDA can assist you in identifying records of your Personal Information in the LACDA’s possession.  The LACDA may need to confirm your identity before providing you with this access and/or assistance, and if the LACDA cannot verify your identity with the degree of certainty required in accordance with its policies and procedures, the LACDA will not be able to respond to your request.  If the LACDA cannot give such access and/or assistance, it will inform you within 30 days of receipt of your request and provide you with a reason.  For assistance, you may contact us using one of the methods listed below, in the “Contacting Us” section.

ACCESSIBILITY. The LACDA is committed to ensuring that its communications are accessible to people with disabilities. To report barriers, please contact the LACDA using one of the methods listed below, in the “Contacting Us” section.

SECURITY.  The LACDA takes reasonable precautions and security measures to maintain the security, confidentiality, and integrity of the information that the LACDA collects, including, without limitation, information collected at the Site.  Such precautions include access controls designed to limit access to such information to the extent necessary to accomplish the LACDA's objectives.

This information should not be construed in any way as giving business, legal, or other advice, or warranting as fail proof, the security of information collected by the Site and/or the LACDA.  Please note that no security system is impenetrable and that the LACDA does not guarantee the security of its systems or the Site's systems.  In the event that information subject to this Privacy Notice is relevant to a security breach, the LACDA will take reasonable steps to investigate the breach and where appropriate, the LACDA will notify those whose information may have been compromised and may take other actions, in accordance with any applicable statute, regulation, executive order, court order, subpoena, ordinance, litigation hold, investigation, audit, study, statistical analysis, research, report, recording, and/or other similar proceeding, and/or any applicable governmental policy or procedure."
